At Digital Power Solutions we strive to help our customers protect their privacy while using our services. To protect your privacy, digitalpower.solutions has instituted a number of policies that give you information and control. This privacy statement discloses our practices for the gathering and use of information from visitors to our own digitalpower.solutions Web site, (www.digitalpower.solutions), from people who register for services that we offer online, or choose to write reviews for publication online, and from people who submit their information through our services provided on behalf of our clientele.

DigitalPower.Solutions:

  • Will provide a link to this privacy statement on all pages that ask for personal information.
  • Will not store or release personal identifying information about you without first obtaining consent.
  • Will not knowingly collect or use personal identifying information from children younger than 13 without parental consent.

This privacy statement discloses our practices for the gathering and use of information from visitors to our own digitalpower.solutions Web site, (www.digitalpower.solutions), from people who register for services that we offer online, or choose to write reviews for publication online.

Registration information may be used:

  • To enable us to process, validate and verify service requests
  • To give our own Web site designers information that’s useful for developing new features and services that meet registrants’ needs
  • To tailor the registrant’s experience on our site, showing them content we think might interest them or altering the content according to their preferences.

For example, we may tell an advertiser that X number of visitors visited a certain area on a Web site or that Y number of men and Z number of women filled out registration forms, but we would not disclose anything that would identify those individuals. We share this information only on an aggregate, anonymous basis and never on an individual basis. We do not merge or enhance information you give us with information obtained from third parties.

In case you change your mind about information you have given us or if some of it has changed, we will endeavor to provide a way to correct, update or remove personal information you have given us. You can do this by contacting us at data-deletion@digitalpower.solutions.

Cookies

The digitalpower.solutions service uses cookies. We use cookies to deliver content specific to your interests, and to recognize you when you visit our site. Your browser offers so-called “cookies”, which–if you allow their use–store small amounts of data on your computer about your visit. Cookies assist us in tracking which of our features you like best. And when you re-visit, cookies can enable us to customize our content according to your preferences. IP Addresses

An Internet Protocol (IP) address is a number assigned to your computer (and/or network) whenever you surf the Web. An Internet Service Provider randomly assigns the IP address at the time of connect. For other local area network (LAN) or cable modem users, the IP address may be permanently assigned to a particular computer or other device connected to the network. Anytime you connect to a site on the Internet, the computers communicating with each other exchange IP addresses. IP addresses can tell things like what part of the world you’re connecting from, or which Internet Service Provider you are using.

We collect IP addresses for system administration and to report aggregate information. We may use your IP address to:

  • Help diagnose problems with our servers
  • Administer our/your Web sites
  • Help identify your Internet Service Provider
  • Gather broad, anonymous information.

We do not link IP addresses to anything personally identifiable, which means that a user’s computer session is logged, but the computer user remains anonymous. Some services we may offer, such as chat rooms or forums, may from time to time display the participant’s IP address along with the message poster’s user name (which may be real or fictional by choice).

Other Information We Gather

When you visit or log into our website, we use cookies and similar technologies to collect certain information about your visit. This includes (i) Usage Data (Information about how you use our site, such as pages visited, time spent on pages, and links clicked.) (ii) Device Information (Details about the device you use to access our site, including IP address, browser type, and operating system.) and (iii) Personal Data (If you provide it, we may collect information such as your email address, phone number, or other contact details). We may also combine this information collected automatically with other data we receive from third-party sources, such as data providers and marketing partners, to create a more complete profile of you. We then use this profile to communicate with you, including providing personalized advertising and promotional content based on your interests and browsing behavior. You may opt out of this at any time. Through our technology, we also collect and accumulate other anonymous data that helps us understand and analyze the Internet experience of our visitors. For example, we accumulate visitor data relating to the type of browsers used, types of modems, modem speeds, operating system software (e.g. Windows XP vs.7), screen resolutions, color capabilities and JavaScript enabling. None of this information is personally identifiable and we only share this information in the aggregate, reflecting overall Web site or Internet usage trends.

Other Sites

This privacy policy applies only to digitalpower.solutions. Users of our site should be aware that through links they could be directed to other sites that we do not control. For example, if you click on a banner advertisement or on a search result or ranked site, the click takes you off the digitalpower.solutions site and sends you to a site controlled and operated by a third party. These sites may send you cookies, collect your personal information or provide offensive content. digitalpower.solutions has no control over the privacy policies or practices of these other sites, and digitalpower.solutions is not responsible for the privacy practices or the content of Web sites to which we link, list, rank, or identify by means of a search. digitalpower.solutions takes no responsibility for the products, services, policies, or actions of third parties or the content of third party Web sites. In addition, digitalpower.solutions will not censor or edit the content of sites on the World Wide Web. We encourage you to be aware when you are leaving our sites and to read the privacy policies of each Web site you visit.

Security

Our site has physical, electronic, and managerial security measures in place to protect the loss, misuse and alteration of the information under our control. We use secure servers with encryption for certain transactions and confidential data. We maintain a firewall to protect data within our local area network and our servers are maintained in secured access, locked facilities.

Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security of any information you transmit, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems. You can report network abuse and any risk of security violations to us by e-mailing info@digitalpower.solutions.

GDPR Compliance

The Data We Collect:

  • From Leads (visitors who convert on behalf of our customers who voluntarily offer information.)
    Collecting: Name, email address, phone number, postal code, vehicle information including payoff information, estimated credit score (unverified), and buying intention.
    Purpose: As part of our service, we collect voluntarily submitted personal contact information and information about the unit for trade in evaluation purposes.

  • From Users (our customers' staff members who desire access to the back end of our tools)
    Collecting: Name, email address, phone number, image avatar which may be a photo or likeness, position.
    Purpose: Necessary for the provision of notifications and dashboard access.

  • Accuracy
    We rely on submitters to submit accurate information. Users can log in to update their incorrect information, and users are notified of Lead Information is unable to be validated through a third party validator, which we only use to determine phone number and/or email address validity, not accuracy.

  • Storage and Lifespan
    User and Lead data is maintained for the duration of the account lifespan of the company retaining our service.
    Purging of personal data occurs upon request, by either

    • The company: (purging whenever and whichever data they request), where data is maintained for a period of time after the closure of a contract to allow for exportation by company users.
    • The Lead: At the time of, or within a reasonable time of, the request by the lead.
  • Integrity and Confidentiality
    Reasonable measure is taken to ensure access to collected data is only available to staff members who need access to it.

  • All information is collected, transmitted (in transit) and stored (at rest) in an encrypted state.

  • Accountability
    We have a Data Protection Officer in place, an extensive audit log mechanism, and a regular audit of recognizable 'high risk' activities such as a.i. analysis, sharing with or through Agencies, Partnerships and/or OEM relationships, etc.

Removal of Your Private Information

The process to remove your data is a manual one but we take it seriously. We have no direct interest in retaining your data other then for convenience on behalf of our dealership customers, who may not have maintained their copies adequately. Therefore, there is no benefit to us not fully honoring these requests to the best of our ability.

The process will involve one or more of the following steps:

  1. Collect: Collect the request from the claimant (that's you)
  2. **Verify:**Make an attempt to verify that you own the data you are requesting to be removed. We will do this by sending you a code to your email address and asking for it via an SMS message
    • We must verify that you own at least one of either the email address submitted or the cellphone number submitted.
    • If neither of those are a match, we will assume the data is either not yours, not submitted by you, or does not personally identify you in any legitimate way, and we will not remove it
  3. **Inform:**Once we verify that we believe the data is yours, we will:
    • Reach out to the business(es) who have had your data transmitted to them as part of our service.
    • Let them know you are requesting the removal of your data and how we verified it.
    • Let you know who they are, and where and to whom we have sent that information.
    • We are no longer able to assist you further with your data at that other business.
  4. Anonymize: In our own systems, we will anonymize your data in every place where it resides in our databases *. This means that any part of the data that is recognized as personally identifiable information, will be altered permanently to a different value, like "Anonymized," "anonymized@anonmous.anon," and "000-000-0000" for examples.
  5. Notify: Then we will let you know the process is complete, the data and time it was completed, and this declaration will be 'signed' by 2 officers of this company "Digital Power Solutions" or its parent company "Apex Mercury, LLC". This 'signing' will be recognized by having both signing parties being copied on the acknowledgement email and responding their confirmation of the data purging.

We will then close this case. The only place that your data will be retained, is in the email exchange(s) that exists between you and Digital Power Solutions during your intentional communications with us, such as those between you and the officers of the company during the course of this request.

You have rights. If you do not agree with this process, you have the right to request another process, and we have the right to consider its legitimacy, to confer with our legal counsel, and to determine an approach from there. We will work with you, but only within reason. We recognize your right to have your information privatized, but in the effort, we must protect ourselves as well. We will make what we believe to be all necessary efforts to do both adequately.

* This applies to data volunteered by you that you may have been unaware was being stored or transmitted to another party via a service such as TradeCycle (or others that we maintain). Any information used in email communication between you and Digital Power Solutions during the intentional communication with us by you for any reason will not be erased.

Legal Disclosures of Information

EXCEPT UNDER THE FOLLOWING CIRCUMSTANCES, DIGITALPOWER.SOLUTIONS WILL NOT SHARE YOUR PERSONALLY IDENTIFIABLE INFORMATION WITH A THIRD PARTY WITHOUT YOUR PRIOR CONSENT. There are a limited number of situations where we may disclose your personal information to others without first receiving your consent: (1) when legally ordered to do so by a lawful subpoena or court order, (2) if you violate or breach an agreement with us, (3) if we believe conduct by you will harm the property or rights of digitalpower.solutions or those of digitalpower.solutions’s users, or (4) under exigent circumstances to protect the physical safety of digitalpower.solutions, its employees, users, or the general public.

Your Acceptance

By using our site, you signify your agreement to the privacy policies described above. If you do not agree with our privacy policies, please do not use our site. Your continued use of our sites following posting of changes to these privacy policies means you accept those changes.
